By accessing and using TicketGate ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

These Terms of Service apply to all users of the Platform, including event organizers, attendees, and browsers.

2. Description of Service

TicketGate provides an online platform that connects event organizers with attendees. The Platform allows:

  • Event organizers to create, manage, and sell tickets to events
  • Attendees to discover, purchase, and manage tickets to events
  • QR code-based check-in and attendee management
  • Payment processing and order management

3. User Accounts

3.1 Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service or for any other reason at our sole discretion.

4. Event Organizer Responsibilities

As an event organizer using the Platform, you agree to:

  • Provide accurate and complete event information
  • Honor all ticket sales and refund policies stated in your event listing
  • Comply with all applicable laws and regulations
  • Not create events that promote illegal activities, hate speech, or violence
  • Not use the Platform to sell counterfeit or unauthorized tickets
  • Maintain appropriate insurance and permits for your events

5. Ticket Purchases and Refunds

5.1 Purchases

When you purchase a ticket through the Platform, you enter into a contract directly with the event organizer. TicketGate acts as an intermediary to facilitate the transaction.

5.2 Refunds and Cancellations

Refund and cancellation policies are set by individual event organizers. Please review the specific refund policy for each event before purchasing tickets.

5.3 Event Changes or Cancellations

Event organizers are responsible for notifying attendees of any event changes or cancellations. In case of event cancellation, refunds will be processed according to the event's refund policy.

6. Payment Processing

Payment processing is handled through third-party payment processors. By using the Platform, you agree to the terms and conditions of our payment processors.

TicketGate charges a service fee on ticket sales. Fees are clearly displayed before purchase completion.

Event organizers receive payouts according to the payout schedule outlined in their organizer agreement.

7. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload viruses or other malicious code
  • Attempt to gain unauthorized access to the Platform
  • Interfere with or disrupt the Platform's operation
  • Use automated systems to access the Platform without permission
  • Resell tickets above face value where prohibited by law
  • Engage in fraudulent ticket sales or purchases

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by TicketGate and are protected by international copyright, trademark, and other intellectual property laws.

Event organizers retain ownership of their event content but grant TicketGate a license to display and promote their events on the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, TicketGate shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.

TicketGate is not responsible for:

  • The quality, safety, or legality of events listed on the Platform
  • The accuracy of event information provided by organizers
  • The conduct of event organizers or attendees
  • Disputes between organizers and attendees

10. Indemnification

You agree to indemnify and hold harmless TicketGate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or violation of these Terms of Service.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Platform.

Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
